Mandatory recording of working hours
The mandatory recording of working hours was established by the decision of the Federal Labor Court (BAG) on September 13, 2022. Accordingly, all employees in Germany are obliged to record all working hours. Employers, in turn, are responsible for introducing a system that enables employees to comply with the mandatory recording of working hours and thus record the time worked. With this regulation on mandatory working time recording, the BAG is referring to a ruling by the European Court of Justice (ECJ), which issued a ruling on the interpretation of the Working Time Directive on May 14, 2019. Specifically, the ECJ ruled that the individual member states of the European Union must oblige their respective employers to set up such a system for recording daily working hours.
